§ 1

General provisions

  1. The privacy policy and the use of cookies on the website www.discushobby.com (hereinafter referred to as the "Policy") was created and adopted by RW-ZONE ROBERT WESOŁY.
  2. The terms used in the Policy mean:
      1. Website: website www.discushobby.com;
      2. User: an entity using the publicly available Website;
      3. Owner: RW-ZONE ROBERT WESOŁY, Kanclerska 16 Gortatowo, 62-020 Swarzędz, 751-110-37-62,
  3. Cookies: text files sent by the Service and saved on the User's end device, which the User uses when browsing websites. The files contain information necessary for the proper functioning of the Service. Cookies most often contain the name of the domain of the website from which they originate, the time of their storage on the end device and a number;
  4. The purpose of the Policy is in particular:
      1. providing Users with information on the use of Cookies on the Website, required by law, including the Telecommunications Law;
      2. ensuring Users’ privacy protection to the extent that it complies with the standards and requirements specified in applicable legal regulations.
      3. The Owner limits the collection and use of information about Users to the minimum necessary to provide services to them.
      4. In order to gain full access to the content and services offered by the Owner through the Website, it is advisable to accept the terms set out in the Policy. Acceptance can be accomplished through the software settings installed on the User's device or through the service configuration.
  5. The following legal provisions, among others, apply:
      1. Act of 16 July 2004 – Telecommunications Law (Journal of Laws of 2017.1907, item XNUMX, as amended);
      2. Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws of 2017.1219, item XNUMX, as amended);
      3. Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ L 119, 4.5.2016) together with Polish provisions on personal data protection.
      4. Act of 10 May 2018 on the protection of personal data (Journal of Laws of 2019, item 1781).

§2

Privacy and personal data protection

User data is processed by the Owner in accordance with the law. User personal data obtained by the Owner is processed based on the User's consent or the existence of another basis authorizing data processing in accordance with the law, in particular the Regulation.

  1. The Owner takes special care to protect the interests of data subjects and in particular ensures that the data is:
      1. processed lawfully, fairly and transparently for Customers and other data subjects;
      2. collected for specific, explicit and legitimate purposes and not further processed in a manner inconsistent with these purposes;
      3. adequate, relevant and limited to what is necessary for the purposes for which they are processed;
      4. correct and, if necessary, updated;
      5. kept in a form which permits identification of the data subject for no longer than is necessary for the purposes for which the data are processed;
      6. processed in a way that ensures appropriate security of personal data, including protection against unauthorised or unlawful processing and accidental loss, destruction or damage, using appropriate technical or organisational measures,
  2. The Owner applies appropriate technical and organisational measures to ensure the protection of processed personal data appropriate to the nature, scope, context and purposes of processing and the risk of infringement of the rights or freedoms of natural persons.
  3. The Owner strives to systematically modernize the IT, technical and organizational measures used to protect this data, in particular the Owner ensures updates of IT security measures to protect against viruses, unauthorized access and other threats resulting from the operation of the IT system and telecommunications networks.
  4. The Owner may – apart from other cases arising from legal provisions – process the following personal data of the Customer necessary to establish, shape the content, amend or terminate the contract:
      1. Customer's surname and names;
      2. permanent residential address;
      3. correspondence address, if different from the residential address;
      4. the right to object to processing or to restrict processing;
      5. Customer's e-mail addresses;
      6. telephone number;
  5. The Owner may process, with the Customer's consent and for the purposes of advertising, market research and customer behavior and preferences, with the results of such research intended to improve the quality of services provided by the Owner, other data relating to the Customer that are not necessary for the provision of the service electronically.
  6. The Owner provides each User who has made their data available to the Owner in any way with access to the data and the exercise of other rights to data subjects in accordance with the applicable legal provisions in this respect, including the following rights:
      1. the right to withdraw consent to the processing of personal data;
      2. the right to information regarding their personal data;
      3. the right to control the processing of data, including its supplementation, updating, rectification and deletion;
      4. the right to object to processing or to restrict processing;
      5. the right to complain to the supervisory authority and to use other legal means to protect your rights.
  7. The Owner may process personal data in an automated manner, including through profiling, in accordance with the principles set out in the Regulation. In such cases, the Owner's actions are aimed at marketing purposes or the need to personalize communications sent to Users (including tailoring information to the User's needs or expectations). The User has the right to object to such processing of their data – this objection may be expressed by sending a message to the Owner's address.
  8. A person having access to personal data processes it only on the basis of the Owner’s authorisation or a personal data processing agreement and only on the Owner’s instructions.
  9. In connection with the operation of the Website, the Owner uses the services of other entities, including for the performance of the contract with the User. Users' personal data may be transferred:
      1. hosting company,
      2. software providers for operating the Website,
      3. internet service providers,
      4. companies providing courier or postal services,
      5. electronic payment platform providers,
      6. invoicing software providers,
      7. entities providing accounting services,
      8. marketing or advertising service providers.

§3

Cookie policy

  1. Cookies identify the User, which allows the content of the website they are using to be tailored to their needs. By remembering their preferences, it enables the appropriate matching of content addressed to them, including advertisements. The Owner uses Cookies to guarantee an appropriate standard of convenience of the Service, and the collected data is used only within the company to optimize activities.
  2. Cookies are used for the following purposes:
      1. adapting the content of the Website to the User’s preferences;
      2. optimizing the use of the Website, in particular by recognizing the User’s end device,
      3. creating statistics,
      4. maintaining the User's session,
      5. providing the User with advertising content.
  3. The Owner processes statistical information regarding the use of the Website, including session information, IP address, time spent on individual pages and subpages, use of specific service functionalities, and information about the device and web browser. This data is processed in accordance with Article 6(1)(f) of the Regulation, in accordance with the legitimate interest of the controller in facilitating the use of the Website and improving the quality and functionality of the services provided. The processing of this data does not violate the rights and freedoms of Users. User information is not used for any additional purposes.
  4. This data is processed as part of the Owner's ongoing operations, but for no longer than 60 days from receipt of the information. After this time, the Owner may continue to process general statistical data, which will be devoid of any information regarding individual Users.
  5. Please note that in some cases, the software installed on the user's end device for browsing websites (e.g., a web browser) defaults to storing cookies on the user's end device. Users can change their cookie settings at any time. These settings can be changed, for example, to block automatic cookie settings or to notify the user each time they are placed on the user's end device. Detailed information in this regard is available in the software (web browser) settings and instructions.
  6. The user may at any time disable or restore the option of collecting Cookies by changing the settings of their device and web browser regarding the use of Cookies or other similar technologies.
  7. Changing the settings constitutes an expression of objection, which may cause difficulties in using the Service in the future. Completely disabling the option of accepting Cookies will not mean the inability to view the content posted on the Service, except for those to which access requires logging in.
  8. Failure to change the settings means that the data will be placed on the User's end device (using the Service will result in automatic placement of Cookies on the User's end device).
  9. Cookies are stored on the User's devices for no longer than 12 months.
  10. The stored data placed on the User's end device do not cause any configuration changes in the User's end device or the software installed on that device.
  11. Information regarding Cookies also applies to other similar technologies used within the Service.

Miscellaneous

  1. The Policy was adopted by order of the Owner and comes into effect on 14.04.2020/XNUMX/XNUMX. The content of the Policy may be changed in the same manner.
  2. Any deviations from the Policy must be made in writing under penalty of nullity.
  3. The law applicable to the Policy is the law of the Republic of Poland.
  4. In matters not regulated in the Policy, the relevant provisions of law shall apply.
